1. Introduction
Welcome to VIPerks ("Company", "we", "our", "us")! These Terms and Conditions ("Terms") govern your relationship with the digital loyalty card services (the "Service") provided by VIPerks.
Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part, you may not use the Service.

2. Eligibility
To use our Service, you must be at least 18 years old or have the consent of a parent or legal guardian. By using VIPerks, you confirm that you meet this requirement.

3. Digital Loyalty Card Services
VIPerks allows businesses to create and manage digital loyalty cards that customers can store in mobile wallets such as Apple Wallet or Google Pay. Customers can earn stamps or rewards through purchases at participating merchants. Redemption terms and conditions are determined by each individual business.

4. User Accounts
Some features of our Service may require creating an account. You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. Please notify us immediately of any unauthorized use or security breach.

5. Business Owners’ Responsibilities
If you are a business user of VIPerks, you are solely responsible for configuring, managing, and maintaining your loyalty card program. You must ensure compliance with all local laws and regulations. Any fraudulent, abusive, or unlawful use of the Service is strictly prohibited.

6. Payment and Fees
Certain features of VIPerks are subject to subscription or service fees for business users. All payments are non-refundable unless explicitly stated. We reserve the right to update pricing at any time with appropriate notice.

For any custom-built systems or feature requests, full or partial advance payment is required before development begins. This payment is non-refundable as it covers tailored design, dedicated resources, and system implementation specific to your business. By confirming a custom order, you agree to these terms and waive the right to request a refund.

7. Intellectual Property
All content, functionality, trademarks, and branding associated with VIPerks remain the exclusive property of VIPerks and its licensors. No use of our intellectual property is permitted without our prior written consent.

8. Termination
We reserve the right to suspend or terminate your access to VIPerks at any time without prior notice if you violate these Terms. Upon termination, your right to use the Service will end immediately.

9. Limitation of Liability
VIPerks, its team, partners, affiliates, or licensors shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

Loss of profits, data, or goodwill

Unauthorized access to your account or data

Service interruptions, viruses, or errors

Content accuracy or user conduct
Use of the Service is at your own risk.

10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Qatar, without regard to conflict of law principles.

11. Changes to Terms
We may revise these Terms at any time. If changes are material, we will provide 30 days’ notice prior to enforcement. We reserve full discretion to determine what constitutes a material change.
